Terms of use

1. The service

Do you Prefer is a free mobile app published by Théo Blanchet. It lets you publish polls, vote in them, comment on them and talk with other members. The service is provided "as is" and may change, be interrupted for maintenance, or be discontinued with reasonable notice.

2. Your account

• You must be 13 or older. Between 13 and 15, a parent's consent is required.
• One account per person. Your sign-up information (country, date of birth, gender) must be accurate: it determines your right to vote in polls, and a false declaration skews the results for everyone.
• You are responsible for what happens with your account. Keep your password to yourself.
• You can delete your account at any time from your profile.

3. What you publish

You remain the owner of your polls, comments, messages and photos. You grant us the right to display, store and transmit them as part of the service, for as long as they are published there. You warrant that you have the right to publish what you put online, including your profile photo.

4. The rules

The following are prohibited in polls, comments, messages, usernames, bios and photos:

• harassment, threats, incitement to hatred or violence, discrimination;
• sexual content, in particular anything involving minors;
• publishing other people's personal information (address, phone number, private photos);
• spam, advertising, scams, impersonation;
• content that is illegal in France, and manipulation of the service (fake accounts, automated votes).

Polls on serious or divisive topics are welcome, provided they stay within these rules. Debating yes, insulting no.

5. Moderation

• Any content and any account can be reported from the app. Every report is reviewed within 24 hours.
• You can block a member: their content disappears for you and they can no longer write to you.
• Content that breaks the rules is removed. Depending on the severity, its author is warned, suspended or permanently banned, without refund since the service is free.
• We may report to the authorities any content that requires it.

6. Private messages

Nobody can write to you until you turn the option on in your profile, and you can turn it off whenever you want. The rules in section 4 also apply to private messages.

7. Poll results

Results reflect the votes of members who meet the poll's declared conditions. They have no scientific or representative value. Conditions are self-declared: we do not verify members' identity.

8. Liability

Content published by members is the sole responsibility of its authors. We do our best to keep the service running and to moderate quickly, without guaranteeing permanent availability or the absence of inappropriate content before it is reported. We cannot be held liable for any indirect damage related to the use of a free service.

9. Intellectual property

The Do you Prefer name, logo, design and app code belong to us. You may not copy them, resell them or make derivative works from them.

10. Personal data

The processing of your data is described in the privacy policy, which forms part of these terms.

11. Changes and governing law

These terms may change; you will be notified in the app of any significant change. They are governed by French law. In the event of a dispute, an amicable solution will be sought first via contact@doyouprefer.app. Failing that, the French courts have jurisdiction.
